"Cheyne Trades" refers to Cheyne Trades Property Maintenance, operating in Central and West London. "Customer" means the person or company engaging Cheyne Trades to carry out works. "Works" means the maintenance, repair or installation services described in any estimate, work order, email or verbal instruction agreed between the parties. "Contract" means the agreement between the Customer and Cheyne Trades, incorporating these terms.

These terms govern all works carried out by Cheyne Trades and supersede any other terms the Customer may seek to introduce. By instructing Cheyne Trades — whether by phone, WhatsApp, email or booking form — the Customer agrees to these terms. No modification to these terms is effective unless agreed in writing by both parties.

All works are charged at our published hourly rates unless a fixed-price written estimate has been accepted by the Customer. There is a minimum charge of one hour per visit. Thereafter, charges are made in 30-minute increments, rounded up.

Where Cheyne Trades provides a written estimate, this is based on information available at the time. If additional issues are discovered during the works, Cheyne Trades will inform the Customer before proceeding with any additional charges.

A materials collection fee of £50 + VAT applies where specialist parts are not carried as standard van stock. All parts and materials are charged at cost plus a mark-up of up to 65%, reflecting trade discount obtained by Cheyne Trades.

All prices are exclusive of VAT, which will be added where applicable.

Standard customers: Payment is due on completion of works.

Account customers: Invoices will be issued within 14 days of completion. Payment is due within 30 days of the invoice date.

Where a third party (such as a managing agent or tenant) arranges works on behalf of the Customer, the Customer remains liable for payment. Late payments will accrue interest at 4% above the Bank of England base rate. Cheyne Trades reserves the right to withhold certificates, guarantees and documentation until payment is made in full. Title in all materials and parts supplied by Cheyne Trades remains with Cheyne Trades until payment is received in full.

Cheyne Trades will use all reasonable endeavours to attend at the agreed time. Attendance times are estimates and Cheyne Trades accepts no liability for delays caused by circumstances beyond its control including traffic, prior jobs overrunning, or supply chain issues.

The Customer must ensure safe, clear access to the property and working area. The Customer must provide power and a clean water supply where required. Cheyne Trades will not be required to enter any property where the sole occupant is a minor.

It is the Customer's responsibility to obtain any permits, consents or permissions required in connection with the works. The Customer shall indemnify Cheyne Trades against any claims arising from failure to obtain such permissions.

Where works involve drainage, the Customer should provide drain layout plans where available. Additional charges may apply if unidentified drains need to be traced.

Cancellations made less than 2 hours before a scheduled appointment will incur a cancellation fee of £50 + VAT. If a Cheyne Trades operative has already arrived on site, a minimum one-hour charge at the applicable rate will apply.

For planned works with an accepted written estimate over £1,000, the Customer has a 14-day cooling-off period from acceptance, during which they may cancel without charge, provided works have not commenced.

Cancellations outside the cooling-off period may incur charges of 5–20% of the estimate value depending on notice given.

Cheyne Trades guarantees all workmanship for 12 months from the date of completion, provided that the works have been paid for in full and any defect is notified in writing within that period.

This guarantee does not cover: manufacturer defects in parts or materials (which carry the manufacturer's own warranty); damage caused by misuse or third-party interference; structural defects not caused by Cheyne Trades; or roofing works where the overall roof condition was assessed as poor prior to works commencing.

The Customer must notify Cheyne Trades of any complaint within 7 days of completion. Cheyne Trades must be given reasonable opportunity to inspect and remedy any agreed defect before any third-party contractor is engaged.

Cheyne Trades's liability is limited to: rectifying defective workmanship under the guarantee in clause 8; liability for death or personal injury resulting from our negligence; and reasonable repair costs for damage to the Customer's property caused directly by our negligence.

Cheyne Trades will not be liable for damage to any part of the property that results from a pre-existing defect or weakness in that part, whether or not Cheyne Trades was working on it. Cheyne Trades accepts no liability for frozen or fractured pipes.

Cheyne Trades shall not be liable for any failure or delay in carrying out works caused by circumstances beyond its reasonable control, including but not limited to severe weather, industrial action, supply shortages, or acts of God.

Unless agreed in writing, the Customer is responsible for the removal of all waste materials arising from the works. Cheyne Trades operatives will leave the working area tidy but are not responsible for disposing of waste off-site unless this is specifically included in a written estimate.

Cheyne Trades collects personal data (name, contact number, email, postcode) solely for the purpose of managing bookings and communicating about works. We do not sell or share your data with third parties. Data is retained for a period of 6 years in line with our legal obligations and then securely deleted. You may request deletion of your data at any time by contacting info@cheynetrades.co.uk.

These terms are governed by the laws of England and Wales. Any dispute arising from these terms or the works shall be subject to the exclusive jurisdiction of the courts of England and Wales.
